Bluethenics is available to users aged 10 and above worldwide. By using the Service, you represent and warrant that you meet the applicable age requirements and, where required, have obtained the appropriate parental or guardian consent.

Subject to your compliance with these Terms, Bluethenics grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Bluethenics application on a compatible device you own or control, solely for your personal, non-commercial fitness and wellness purposes.

Bluethenics provides fitness tracking, workout logging, and wellness tools for informational and personal use only. The content and features of the Service do not constitute medical advice, diagnosis, or treatment of any kind.
Always consult a qualified healthcare professional or physician before beginning any new exercise program — particularly if you have a pre-existing medical condition, injury, or health concern. This applies to users of all ages. For users under 18, parental guidance on exercise programs is strongly recommended.

Certain features or content within Bluethenics may require payment. By completing a payment through any supported method (including QR code payment or other supported channels), you agree to the following:
All content, features, design, branding, graphics, trademarks, trade names, logos, and software comprising the Bluethenics Service are the exclusive property of Bluethenics and its licensors, protected by applicable intellectual property laws worldwide.
You may not use, copy, reproduce, modify, distribute, or create derivative works from any Bluethenics intellectual property without our prior written consent. Unauthorized use may result in civil and/or criminal liability.
The Bluethenics name and logo are trademarks of Bluethenics. Nothing in these Terms grants you any license to use our trademarks, trade names, or brand assets.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, protect, and share your personal and health data, and outlines your rights under GDPR, CCPA/CPRA, COPPA, and other applicable data protection laws.
By using the Service, you acknowledge that you have read and understood our Privacy Policy. For users under 13 (US) or under 16 (EEA/UK), the consenting parent or guardian acknowledges the Privacy Policy on the child's behalf.
We use email and hashed-password authentication to secure your account. We never store, transmit, or access your plain-text password.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
We do not warrant that the Service will be free of errors, uninterrupted, secure, or that results obtained will be accurate or reliable. Some jurisdictions do not allow the exclusion of implied warranties; in such jurisdictions, exclusions apply to the fullest extent permitted by law.
To the maximum extent permitted by applicable law, Bluethenics and its directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, personal injury, or property damage — arising from or related to your use of or inability to use the Service.
Our total aggregate liability to you for any claim arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to Bluethenics in the 12 months preceding the claim, or (b) USD $10.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under applicable mandatory law. Consumer protection laws in your jurisdiction may grant you rights that these Terms cannot override — those rights remain fully intact.
You agree to defend, indemnify, and hold harmless Bluethenics, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
We reserve the right to suspend or permanently terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or if continued provision of the Service would create legal exposure.

Nothing in these Terms affects your rights as a consumer under the mandatory laws of your EU member state. You retain the right to bring proceedings before the courts of your country of habitual residence. EU users may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Your statutory consumer rights under UK law (including the Consumer Rights Act 2015) are unaffected by these Terms.
Any dispute not resolved informally shall be submitted to binding individual arbitration under the rules of a recognized arbitration body. Class action waiver: you agree that disputes will be resolved on an individual basis only. This arbitration clause does not apply to claims eligible for small claims court.
Any disputes shall be governed by internationally recognized principles of law, and you may bring claims before the courts of your country of residence where mandatory consumer law requires it.
